I. Purpose and Scope

This is the campus policy on preventing and responding to acts of workplace violence that involve employees, students, or visitors. For policy at UCDHS, see UCDHS Policy & Procedure Manual Section 1616.

II. Definitions

"Workplace violence," as used in this section, includes both violence and disruptive or threatening acts that can lead to violence. A finding that a violation of A or B below has occurred is not a finding that a violation of C has occurred.

A. Disruptive behavior--actions that disrupt normal work activities, such as yelling, wild gestures, or demands for an immediate answer.

B. Threatening behavior--a verbal or written statement or a physical action that would cause a reasonable person to fear for his or her safety or the safety of others.

C. Violent behavior--a physical assault on a person, or a physical action intended to damage property.

III. Policy

A. UCD is committed to an environment that is free from workplace violence. UCD will not tolerate workplace violence by any member of the UCD community or visitor. Academics, staff, administrators, or students who violate this policy may be disciplined as described in the applicable policy or contract, up to and including dismissal.

B. Some violations of this policy are also violations of the law. When appropriate, UCD will refer such cases for civil action or criminal prosecution.

C. It is against the law to possess guns or some types of knives on UCD property. See California Penal Code Sections 626.9 and 626.10.

D. A person may be excluded from UCD premises for an act of workplace violence.

1. A UCD employee or student may be suspended or put on investigatory leave as described in the applicable policy or contract.

2. Any person may be excluded from UCD property after notice has been given under the Penal Code statutes described in Section 290-04.

3. Any person may be excluded from UCD property by a court-issued restraining order.

E. A department head, manager, or supervisor who learns of an incident of workplace violence shall respond as follows.

1. Disruptive behavior: Take action to stop the conduct, or report as described below.

2. Threatening or violent behavior: Report the conduct to his or her supervisor, and to the Workplace Violence Response Team.

Employees other than those named above and students are urged to report workplace violence.

F. The role of the Workplace Violence Response Team is to advise department chairs, managers, supervisors, and other members of the UCD community, to provide recommendations for responding to an incident, and to facilitate access to resources. It also advises on ways to promote safety and prevent violence.

IV. Procedure

A. Emergency

To report an emergency or a crime in progress, dial 9-1-1.

B. Report of a crime

To report a crime that occurred on UCD property, call the UCD Police Department at 530-752-1230. To report a crime that occurred off campus, call the local police or sheriff's department.

C. Reporting workplace violence

Any member of the campus community may contact the appropriate Workplace Violence Response Team via the following offices.
